ABHISHEK REDDY ORAL ORDER 14-11-2024 After arguing the matter at length, learned counsel for the petitioners seeks permission to withdraw the present writ petition with the liberty to participate in the open auction which is likely to be conducted by the authorities for the Shop No. C-5 at Ambedkar Bazar, Purnea.

2. Learned counsel appearing on behalf of the respondents states that in case any auction is held for the allotment of Shop No. C-5, the same shall be done in an open and transparent manner.

Having regard to the same, the present writ petition is disposed of granting liberty to the petitioners to participate in the open auction, till such time the auction is held, the authorities are directed not to dispossess the petitioners. The petitioners shall continue to pay the monthly rent/ lease amount and any other charges levied by the authorities. It is made clear that if the petitioners are unsuccessful in the open auction, they shall vacate the premises immediately and hand over the peaceful possession of the shop to the authority concerned.

4. With the above direction, the present writ petition stands disposed of.
