Petitioner is named in the first information report but according to the prosecution case itself, there was land dispute between the parties and the deceased proceeded in the company of the petitioner and some other accused and later on, his dead body was recovered on a railway track.

Investigation has already been completed and from perusal of the impugned order, it would appear that except the aforesaid fact, witnesses have stated nothing.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Raxaul at Motihari in Ramgarhwa P.S.
