The petitioner is accused in connection with Aurai P.S. Case No. 140 of 2015, registered under Section 302/34 of the Indian Penal Code and Section 3(2)(v) of SC/ST Act. The accusation is that husband of the informant was called by six accused persons, including the petitioner, and after committing the murder of husband of the informant, his dead body was thrown near the railway track. The cause of occurrence is that ten days prior of the occurrence, co-accused Awadh Kishore Singh, who is a P.D.S. dealer refused to give the grains to the husband of the informant and also caused assault to him regarding which his husband had given application before the Police and due to that reason, accused persons also threatened
Patna High Court Cr.Misc. No.2551 of 2016 (3) dt.16-03-2016 2/2 his husband for dire consequences.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that informant is not the eye-witness of the occurrence and mere on suspicion, the name of the petitioner and others has been implicated in this case. Further submission is that petitioner has no criminal antecedent and he is in custody since 23.10.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Aurai P.S.
