JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 The petitioner seeks regular bail in connection with Chautham P.S. Case No. 153 of 2018, registered for offences punishable under Sections 25(1-B)a/26 of the Arms Act. Allegation is of recovery of a country made pistol and en empty cartridge from the garage of the petitioner. Earlier the prayer for bail of the petitioner was dismissed vide order dated 26.10.2018 passed in Cr. Misc. No. 64299 of 2018 with liberty to the petitioner that he may renew his prayer for bail once charge is framed or he completes six months in judicial custody.

Submission of learned counsel for the petitioner is that the has remained in judicial custody for six months and the charge has also been framed.

Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Khagaria, in connection with Chautham P.S. Case No. 153 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
