The petitioner apprehends his arrest in connection with Bachhwara Police Station Case No. 143 of 2022, dated 17.06.2022, registered for the offence punishable under Sections 147/148/149/341/323/427/307/332/353/431/504 of the Indian Penal Code and Section 8 (B) of the National Highway Act, 1956.

As per the First Information Report, during protest of 'Agneepath Scheme', 31 named and 100-150 unknown persons, allegedly, assembled and obstructed road traffic, burnt tyres and damaged the vehicles etc.

Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.7839 of 2023(2) dt.18-05-2023 2/2 case due to local politics. He also submits that the allegation against the petitioner is not specific; rather, the same is general and omnibus in nature. He next submits that the petitioner has got no criminal antecedent.

Regards being had to the submissions made by the parties and taking into consideration the fact that petitioner is a student and there is general and omnibus allegation against him, I am inclined to grant anticipatory bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, named above, in the event of arrest or surrender within four weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bachhwara Police Station Case No. 143 of 2022, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
