JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with K. Hat (Maranga) P.S. Case No. 760 of 2019, registered for offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

As per F.I.R. one country made pistol and one cartridge was recovered from the bed of the petitioner and it further appears from the impugned order that one co-accused has made confession in connection with other case that after firing, he has handed over the pistol to the petitioner, which has been recovered in this case.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the recovery is from the bed, where, three persons sleep. Further he has no criminal antecedent and he has been in custody since 11.10.2019.

Having heard both sides, considering the facts and circumstances, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed, petitioner will be at liberty to renew his prayer for bail. (Vinod Kumar Sinha, J) sunilkumar/- U T
