Petitioners seek bail in a case registered for the offences punishable under Sections 302,201,34 of the Indian Penal Code.

Initially the petitioners were granted anticipatory bail on merit of the case in Cr. Misc. Case No.55628 of 2017 on 16.01.2018. However, it was brought to the notice of the court in Cr.Misc.No.37353 of 2018 that the petitioners while getting anticipatory bail had suppressed their criminal antecedent. Therefore, anticipatory bail was cancelled on 28.11.2018 with direction to the petitioners to surrender and pray for regular bail.

Considering the entire facts, let the petitioners, above named, be released on bail after framing of the charges or on completion of two months of custody whichever is earlier on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.71/17/528/17 arising out of Paraiya P.S.Case No.114 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
