Learned Counsel for the petitioner submits that in place of filing an application under Section 14-A (2) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, he has filed the present application under Sections 439 and 440 of the Code of Criminal Procedure, 1973. He thus prays for withdrawal of the present application with liberty to file an application under Section 14-A (2) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
