JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 424 of 2019, registered for offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 4 /5 of the Explosive Substance Act.

Prosecution case is that police on information that arms and ammunition have been kept in the house of petitioner, raided his house, however, petitioner managed to flee away throwing the bag in a maize field and from the said bag four pistols with magazine and 19 cartridges as well as articles for preparing bomb were recovered.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has

Having heard both sides, in view of the allegation as , at this stage, I am not inclined to enlarge the petitioner on bail, however, the trial court is directed to expedite the trial and conclude the same within six months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail.
