JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One unknown dead body was recovered and after that present case was registered. In course of investigation, one Girdhasri Singh appeared before the police and identified the dead body as his brother, namely, Murari Singh. Furthermore, the name of petitioner came in course of investigation when family members of the deceased as well as some other witnesses disclosed before the police that prior to the alleged occurrence deceased had gone along with the petitioner. Admittedly, no one has seen the actual killing of the deceased and, at best, it is a case of last seen for which petitioner is languishing in jail custody since

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Cheriya Bariyarpur P.S. Case No. 35 of 2013.
