JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 30-01-2021 Heard Mr. Madan Prasad Singh No.2, learned counsel for the petitioner and Ms. Asha Devi, learned Additional Public Prosecutor (hereinafter referred to as the 'APP) for the State.
2. The present application has been filed seeking recall of order dated 02.01.2019 by which Cr. Misc. No.28779 of 2014 was dismissed due to non-appearance of learned counsel for the petitioner.
3. Learned counsel for the petitioner submitted that due to some personal reason he could not come to the Court on that day and had requested one of his colleagues to pray for accommodation, but inadvertently, the same could not be done
Patna High Court CR. MISC. No.3085 of 2019 dt.30-01-2021 2/2 and the matter stood dismissed due to non-appearance.
4. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, the Court finds that sufficient cause has been shown for nonappearance of learned counsel for the petitioner on 02.01.2019 in Cr. Misc. No.28779 of 2014, leading to its dismissal.
5. Accordingly, the order dated 02.01.2019 in Cr. Misc. No.28779 of 2014 is recalled. The said case stands restored to its original file and number.
6. The application stands allowed.
