Petitioner seeks regular bail in connection with Rivilganj PS Case No. 312 of 2020 registered for the offence under Sections 341 / 323 / 324 / 307 / 379 / 504 / 34 of the IPC.
Petitioner has allegedly assaulted the informant by means of lathi and knife due to which the informant sustained injuries.
Learned counsel for the petitioner submits that petitioner is the nephew of the informant and there is long standing land dispute between the parties. There is case and counter case between the parties inasmuch as from the side of the petitioner Rivilganj P.S. Case No. 263 of 2020 has been lodged for an occurrence which has taken place on the same
Patna High Court CR. MISC. No.3014 of 2022(2) dt.26-05-2022 2/2 date and time. The petitioner is in custody since 06-10-2020. Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that both the parties are closely related, there is land dispute between them, petitioner is in custody since 06-10-2020 and charge sheet has already been submitted, and as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IXth, Saran at Chapra in connection with Rivilganj PS Case No. 312 / 2020.
