JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Petitioner is languishing in custody since 01.04.2014 in a case registered for the offences punishable under Sections 376/511 of the I.P.C and Sections 6, 7, 8 of the Protection of Children From Sexual Offences Act. It is alleged that the petitioner made an attempt to establish forceful physical relationship with the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that petitioner's brother was married with the sister of the informant but the marriage somehow or other failed, hence as a retaliatory measure the present case has been lodged. It is further submitted that medical opinion does not corroborate the accusation.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.10979 of 2015 (2) dt.24-03-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge(POCSO) Act, Bhagalpur in connection with Sessions Trial No. 612 of 2014, arising out of Dhoraiya(Dhankund) P.S. Case No. 55 of 2014.
