The petitioners being the father and brother of the husband of the victim are languishing in custody since 03.11.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. Subsequently, charge-sheet has been submitted under Sections 304B and 201 of the IPC.

The accusation is of killing the daughter of the informant after four years of marriage and disposing of the dead body.

No.15474 of 2015 (02) dt.12-05-2015 2/2 It is submitted by learned counsel for the petitioners that from the accusation itself it is apparent that there is no eye witness to the occurrence. The victim died due to prolong illness and the informant has subsequently retracted from the initial version, moreover, the investigation has already concluded. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil P.S. Case No. 87 of 2013.
