JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have been caught by the informant, while the he was trying to flee from the place of occurrence after committing the alleged occurrence of theft in the house of the informant but admittedly, nothing has been recovered from conscious possession of the petitioner nor does the petitioner have any criminal antecedent.

The submission on behalf of the petitioner is that daughter of the informant is classmate of the petitioner and as a matter of fact, the informant implicated the petitioner in this false case on the suspicion that petitioner has love affairs with the daughter of the informant.

Patna High Court Cr.Misc. No.2470 of 2016 (2) dt.30-01-2016 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Desari P.S. Case No. 276 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
