JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Bagaha P.S. Case No. 475 of 2019, registered for offences punishable under Section 392 of the Indian Penal Code. Chargesheet has been submitted under Section 395 of the Indian Penal Code.
Prosecution case is that while the informant was going after collecting cash of Rs. 85,112/-, three motorcycle borne miscreants came and taken away his motorcycle and mobile phone. F.I.R was instituted against unknown, later on name of petitioner surfaced on confession of co-accused. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from the possession of the petitioner and save and except confessional statement of co-accused, there is absolutely
Patna High Court CR. MISC. No.938 of 2020(2) dt.16-01-2020 2/2 nothing against the petitioner and although he has been in judicial custody since 21.10.2019 but till dated he has not been put on Test Identification Parade.

Having heard both sides, in view of the submissions as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Bagaha, West Champaran, in connection with Bagaha P.S. Case No. 475 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
