Case No. 188 of 2018, registered for the offences punishable under Sections 302, 201 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the FIR along with several other accused persons and allegation is that they forcibly taken one Vivek Kumar along with them and thereafter he was killed by them.

Submission of learned counsel for the petitioner is that though he is named in the FIR but nothing specific has been attributed against him and he has no criminal antecedent and he is in custody since 15.10.2019 and considering the same other co-accused persons have been granted bail by different coordinate Benches of this Court by order dated 23.10.2019

Patna High Court CR. MISC. No.5716 of 2020(2) dt.03-02-2020 2/2 passed in Cr.Misc.No. 57743 of 2019, by order dated 15.10.2019 passed in Cr.Misc.No.59277 of 2019 and by order dated 18.1.2019 passed in Cr.Misc.No. 79255 of 2018. Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 188 of 2018.
