JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, this petitioner along with co-accused, Sikendra Yadav opened fire from their respective fire arms on the brother of informant as a result of which he sustained fire arms injuries and died during the course of treatment.

Learned counsel appearing for the petitioners submits that petitioner is innocent and has falsely been implicated in the case due to land dispute. Both parties are Gotias and there is land dispute between them. The police after investigation

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that there is direct and specific allegation against this petitioner that he along with coaccused, Sikender Yadav fired on the brother of informant as a result of which he died during the course of treatment. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
