According to the prosecution case itself, petitioner was armed with firearm at the time of alleged occurrence but there is nothing in the first information report which shows that petitioner used the firearm.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Assistant Sessions Judge- cum- Additional Chief Judicial Magistrate, Jamui in connection with Session trial no. 380 A/13 arising out of Sikandra P.S.Case No. 38 of 2013.
