The petitioner seeks bail in connection with Itarhi P.S.Case No.240 of 2014 registered under Section 363 of the Indian Penal Code.

The allegation against the petitioner is that he tried to kidnap the daughter of the informant and apprehended by the father of the victim girl and handed over to the police. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case and that the occurrence is taken place on 29.1.2014 but the FIR has been instituted on 9.12.2014, for which no explanation has been furnished on behalf of the prosecution regarding the delay in instituting the case. Further, it has been submitted that the victim has already been recovered and she is in the custody of her parents. The petitioner has no criminal antecedent and is in custody since 02.1.2015.

Having considered the aforesaid facts, the petitioner , named above, is directed to be released on bail on furnishing bail
