The petitioner seeks bail in connection with Bhawanipur P.S. Case No. 152 of 2019, registered under Sections 341, 323, 302 and 34 of the Indian Penal Code. The accusation is that due to petty dispute, Sudhir Thakur (petitioner), Sanjeet Thakur, Sakuna Devi and Punam Devi started to cause assault to Nand Kishore Thakur, husband of the informant, Sulekha Devi, through fists and slaps. In the meantime, Sanjeet Thakur caused injury through the handle of the hand-pump on the chest and belly of her husband. Her husband was, thereafter, rushed for treatment, but, in the evening of 02.09.2019 he died.

Patna High Court CR. MISC. No.800 of 2020(2) dt.21-01-2020 2/2 Submission is that there of general and omnibus allegation against the petitioner to cause assault. There is specific allegation of causing injury on the chest and belly of the deceased against Sanjeet Thakur through the handle of the handpump. It would also appear from the order, dated 18.12.2019 that an external injury was found on the chest and abdominal region, which is said to be caused by Sanjeet Thakur not by the petitioner. the petitioner is in custody since 15.10.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bhawanipur P.S. Case No. 152 of 2019 to the satisfaction of the Subdivisional Judicial Magistrate, Purnea.
