JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 321, 325, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, all FIR named 13 accused persons including the petitioner and 12 to 17 unknown accused persons assaulted the prosecution party. They also looted ornaments and cash from the house of the informant. Learned counsel for the petitioner submits that the specific allegation of causing fire arms injury to Ram Kumar Mukhiya is against co-accused Sunil Kumar and there is general and omnibus allegation of assault against this petitioner. Petitioner has got clean antecedent.
Learned counsel for the State opposes the bail petition of the petitioner.

No.2215 of 2023(2) dt.08-05-2023 2/2 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Alouli P.S. case no 316 of 2021 subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
