JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2015 Petitioners are languishing in custody since 27.10.2014 and 20.12.2014 in a case registered for the offences punishable under Sections 395, 397 of the I.P.C. The miscreants committed dacoity in the jewellary shop of the informant leading to the registration of the First Information Report against unknown. The name of the petitioners sprang up during investigation on the confession of co-accused Uttam Kumar Singh and Md. Mobarak.

No.13268 of 2015 (2) dt.06-04-2015 2/2 In both the petitions, it is mentioned that neither any recovery has been made nor the petitioner has been put on test identification parade and co-accused Md. Mobarak has been granted bail vide Cr. Misc. No. 9106 of 2015. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 427 of 2013.

Since the petitioners have serious criminal antecedent, let learned Court below positively cancel the bail bonds of the petitioners, if the petitioners get substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
