Mr.Ajay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

The prosecution case in brief is that while the informant was going to Karn Kodariya, his bag containing Tab, Biometric scanner and other belongings were snatched by the miscreants. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 26-07-2018. Charge sheet has already been submitted. The petitioner is not named in the FIR. No test identification parade was conducted in this case. There is no recovery of any incriminating article from possession of the petitioner. The name of the petitioner surfaced in this case on the basis of confessional statement of co-accused.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Saran at Chapra in connection with Mashrakh P.S. Case No. 243 of 2018.
