JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Special Case No. 6116 of 2021 arising out of Gardanibag P.S. Case No. 373 of 2021 instituted for the offences under Sections 30(a), 34 and 37(b) (c) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 02.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case and is a woman.
Learned counsel for the petitioner submits that the allegation is of recovery of 105 litres of liquor from the room of Karan Ram.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.2650 of 2022(2) dt.04-03-2022 2/2 petitioner was not arrested from the spot nor the recovery was made from her house and has been implicated merely because she was known to the petitioner.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case, is a woman and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 6116 of 2021 arising out of Gardanibag P.S.
