The petitioner seeks bail in Matihani P.S. Case No. 181 of 2014, registered for the offences punishable under Sections 307, 302 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant named six persons and 3-4 unknown persons and alleged that all the accused persons having armed with firearm came and made indiscriminate firing. Niraj Kumar Singh son of Balram Singh exhorted Ranjit Don to fire and the firing hit Nilesh Kumar @ Akshay Bharti @ Mehi Singh who died.
Learned counsel for the petitioner submits that the petitioner is a mere member of the mob and there is no allegation
Patna High Court Cr.Misc. No.9998 of 2015 (2) dt.17-03-2015 2/2 of assault against the petitioner. Co-accused Alok Kumar @ Rocky Kumar Singh and Dinkar Kumar have already been enlarged on bail vide order passed in Cr. Misc. No. 6454 of 2015 and 6670 of 2015 respectively.
Considering the facts aforesaid and the fact that there is no specific allegation of assault of firing against the petitioner, the assailant of the deceased is Ranjit Don, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Matihani P.S.
