ANJANA MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.08.2015 in connection with Begusarai Town P.S. Case No.431 of 2015 registered for the offence under Sections 467, 468, 471, 413, 414, 420 and 401 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is alleged recovery of motorcycle from the possession of the petitioner, the said motorcycle purported to have been recovered is not a stolen vehicle nor it is the vehicle which is reported to have been stolen from the informant. Learned counsel further submits that it is only on presumption that the recovered vehicle was a stolen vehicle, that the

Considering the aforementioned facts and circumstances and the period of custody and also that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No.431 of 2015.
