2. The petitioner apprehends his arrest in connection with Gaighat (Benibad) P.S. Case No. 342/2023 for the offence registered under sections 341, 363, 365, 376, 328, 506, 34 of the IPC and Section 4 of the POCSO Act lodged on 29.08.2023 by the informant Radhe Ram.

3. As per the prosecution story, the informant alleged that while he was away, the daughter went missing, she returned next day but was unable to move and was weeping. On enquiry, the victim alleged that Ajay Kumar Mahto and this petitioner, Sanjit Kumar Mahto took her away, confined in a room, provided her cold drink whereafter she became unconscious and

4. The Co-ordinate Bench had called for the case diary and the medical report which shows the gravity of the allegation inasmuch as on the day the victim was examined, she was bleeding.

5. The 164 Cr.P.C. statement of the victim girl is also on record which supports the prosecution story.

6. Though learned counsel for the petitioner tried to impress upon this Court that the actual allegation is against his brother, Ajay Kumar Mahto and also submitted that the medical examination took place after few days, learned APP has submitted that she has named this petitioner along with his brother.

7. Considering the allegation that has come against this petitioner which may cause deep impression in the mind of the minor girl, in that background, no relief can be extended to the petitioner.
