The petitioner seeks bail in a case under Section 302, 201 and other sections of the Indian Penal Code. The petitioner is husband.

The prayer of petitioner for bail was earlier rejected by this court vide order dated 19.01.2015 passed in Cr. Misc. No. 34898 of 2014 with a direction to conclude the trial within nine months from the date of receipt of the order. A report was called for from learned 5th Additional Sessions Judge, Bhojpur at Ara about the stage of Sessions Trial No. 41 of 2014. From perusal of the report, it appears that the court of learned 5th Additional Sessions Judge is vacant. The learned Sessions Judge is requested to transfer

Patna High Court Cr.Misc. No.2561 of 2016 (3) dt.22-06-2016 2/2 the case to a running court so that the trial of the case is held on day to day basis and the same is concluded within six months from the date of receipt/ production of a copy of this order. If the trial is not concluded within six months, the petitioner may renew his prayer for bail.

With this direction, the prayer of petitioner for bail is rejected.
