The petitioner is languishing in custody since 17.10.2014 in a case registered for the offences punishable under Sections 302 and 328/34 of the Indian Penal Code. It is alleged that the husband of the informant was found dead in the room when someone suggested that this petitioner had some illicit relationship with the husband of the informant, who gave some 'Prasad' to the husband of the informant and thereafter the husband of the informant died. Though, subsequently in the viscera poison was found. The informant during trial has been examined as P.W. 1 but has not supported the accusation and has been declared hostile.
