1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a student and on account of dispute amongst children, the present FIR came to be instituted with exaggerated allegation. It is also submitted that allegation against the petitioner is general and omnibus in nature.

4. Learned A.P.P. for the State rebuts the submission of the learned counsel for the petitioner and submits that though it has been submitted that the dispute arose on account of

Patna High Court CR. MISC. No.3808 of 2024(2) dt.13-02-2024 2/2 dispute amongst the children and petitioner is a student but then there is no pleading with respect to the said fact, as such, it appears that a bald submission has been made.

5. Considering the submissions made by the learned APP, the Court is not inclined to entertain the anticipatory bail application.

6. However, in the event if the petitioner surrenders on or before 11.03.2024, the learned Magistrate shall dispose of the bail application on the same day keeping in mind the fact that petitioner is a young boy aged about 19 years and there is no specific allegation against him.
