The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

As per the prosecution case, 3 mobile phones and 2 live cartridges were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. He is in custody since 17.4.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.2342 of 2022(2) dt.24-03-2022 2/2 petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge V, Nalanda at Biharsharif in Giriyak Police Station Case No. 172 of 2021.
