JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was In-charge, Headmaster of a school and it is alleged that he withdrew huge amount under different Government schemes but did nothing and embezzled Government money.
Submission on behalf of the petitioner is that the informant has admitted in his written report that the work to the tune of Rs. 7,96,233/- was done in the financial year of 2010-11 and similarly, part work of same financial year was also done and furthermore, it is stated that construction work of Head Master office was not done and for the aforesaid work, petitioner had

No.8212 of 2016 (2) dt.25-02-2016 2/2 withdrawn Rs. 2,52,855/- It is submitted on behalf of the petitioner that as a matter of fact, when piling work was started local people raised objection in respect of site selection and that was the reason the work could not be done. It is further submitted that as soon as the aforesaid dispute is resolved, the work shall be completed by the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that petitioner is in jail custody since 27.10.2015 and investigation against him has already been completed, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Pali P.S. Case No. 31 of 2015.
