Allegation against the petitioner, who happens to be mother-in-law and the case is of dowry death. Submission of learned counsel for the petitioner is that for the death of the deceased an UD case has been filed by the informant on 5.9.2017 and after two months FIR has been lodged making the allegation of demand of motorcycle and even cremation has been done in presence of the informant. Further submission is that the present case has been lodged with an ulterior motive.

Having heard both sides and in the facts and

Patna High Court CR. MISC. No.4218 of 2019(3) dt.11-03-2019 2/2 circumstances, the provisional bail granted to the petitioner vide order dated 31.1.2019 is, hereby, confirmed in connection with Sugauli P.S.Case No. 383 of 2017, pending in the court of the Chief Judicial Magistrate, Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
