The petitioner has prayed for bail in connection with Sherghati P.S. Case No. 99 of 2001 instituted for the offence under Sections 341, 342, 323, 307, 364, 379, 353/34 of the Indian Penal Code.

The present case was registered in year of 2001 and this case has been committed to the court of sessions on 9.9.2002. At the time of commitment, the petitioner was present before the lower court but after the commitment, the petitioner has never been present before court of sessions. Thereafter, the petitioner surrendered before the court on 14.2.2006 and he was granted bail on 27.2.2006 with a direction that he shall not repeat such mistake in future.

Patna High Court CR. MISC. No.6045 of 2023(3) dt.28-06-2023 2/2 Again the petitioner remained absent due to which his bail bond was cancelled on 11.11.2016 and subsequently he was declared absconder on 27.2.2017.

There is a willful and malafide intention of the petitioner and due to his non-appearance, the trial has been hampered.

Having heard the learned counsel for the parties and considering the fact that the petitioner is habitual absconder and he misused two times privilege of bail, this court is not inclined to enlarge him on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to expedite the trial and conclude the same as soon as possible.
