Heard the parties in virtual Court.
The petitioner is languishing in custody for the offence punishable under Sections 366, 376 and 379/34 of the Indian Penal Code.
This is a case of misuse of privilege of bail. The petitioner is in custody since last one year. Petitioner is ready to fully cooperate with the trial and undertakes not to commit further misuse.
Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below
Patna High Court CR. MISC. No.12781 of 2021(2) dt.06-07-2021 2/2 where the case is pending in connection with Pipra Kothi P.S. Case No. 47 of 1989, with following conditions: (a) If the petitioner would be found non-cooperative in the trial that would a ground for cancellation of bail of the petitioner by the court below itself and the court below shall be at liberty to conclude the trial keeping the petitioner in custody. (b) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(c) The petitioner shall not leave the country without permission of the trial Court.
