JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Rajpur P. S. Case No. 208 of 2012 registered for offences punishable under sections 409/420 of the Indian Penal Code.

The accusation against the petitioner is that the petitioner being owner of Maa Manokamna Devi Mini Rice Mill, Chausa, Buxar received 30924 quintals paddy for milling and to return 20719.08 quintal rice to S.F.C. Godown, Buxar but on verification by the Magistrate 19123.08 quintals rice was found short which is misappropriated.

The learned counsel for the petitioner submits that in

Patna High Court Cr.Misc. No.2903 of 2016 (3) dt.18-03-2016 2/2 fact according to the agreement, after milling of paddy, rice was to be collected by the F.C.I., Buxar but inspite of information given to the S.F.C., Buxar was not collected from the mill of the petitioner and due to the rain rice damaged. Moreover the case is of civil nature and Certificate Case No. 24/ 2012-13 has already been lodged against the petitioner. The petitioner has no criminal antecedent and he is in custody since 03.12.2015. Considering the facts and circumstances, the above named petitioner, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection of Rajpur P.S.Case No. 208 of 2012.
