Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 302, 120B, 504 and 506 of the Indian Penal Code, registered in connection with Jurawanpur P.S.Case No. 61 of 2021. As per allegation, the members of the petitioners' side were engaged in the work of filling of soil over the land. The informant and his father protested, whereupon the accused
Patna High Court CR. MISC. No.2317 of 2022(3) dt.10-08-2022 2/2 persons including the petitioners badly assaulted the father of the informant who died in Primary Health Centre, Fatehpur during the course of treatment.
The learned counsel for the petitioners has submitted that there is no injury on the body of the deceased. The impugned order shows that four injuries were found on the person of the deceased, caused by hard and blunt substance.
There is direct allegation against the petitioners that they assaulted the deceased, as such, they do not deserve the privilege of anticipatory bail. Their prayer for anticipatory bail is hereby rejected.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
