JUSTICE MADHURESH PRASAD ORAL ORDER 16-01-2020 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 147, 148, 149, 307, 353 of the IPC, section 27 of the Arms Act and sections 16,17,18, 20,23, 28 of the U.A.P. Act. Petitioner is not named in the F.I.R. As per F.I.R police raided the place of occurrence on information that Naxalites have assembled for committing some crime. There was firing from both sides and several Naxalites papers and other articles were recovered.

Submission of counsel for the petitioner is that nothing has been attributed against the petitioner. Other co-accused person has been granted bail by a coordinate bench of this court vide order dated 04.12.2019 passed in Cr. Misc. no.76850/2019.

Patna High Court CR. MISC. No.2259 of 2020(2) dt.16-01-2020 2/2 Some of them have already been granted anticipatory bail by a coordinate bench of this court. Further submission is that the petitioner is in custody since 04.09.2019. He is ready to abide by any condition imposed upon him and he is also ready to cooperate in disposal of the trial. Heard learned A.P.P. also.

Having heard both sides, in view of facts and circumstances as stated above, let the petitioner be released on bail on furnishing bail bonds of Rs 25,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in Pipri Bazar P.S. Case no. 83/2019 subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he will not leave the jurisdiction of civil court without prior permission of the court below.
