28-06-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Goh P.S. Case No.150 of 2020, registered for the offence under Sections 420, 467, 468, 413, 414, 120(B), 34 of the Indian Penal Code. As per the prosecution case, on 20.10.2020, during checking of the vehicles, one Scorpio was intercepted and this petitioner alongwith co-accused have been arrested and from their possession, various A.T.M. cards of several persons of different banks were recovered.
It is submitted on behalf of petitioner that nothing has been recovered from the possession of the petitioner. Rather all the ATM cards were recovered from the vehicles and only cash worth Rs. 1500/- (fifteen hundred) was recovered from the

It is further submitted that there is general and omnibus allegation of cheating, but till date, neither any evidence of fabricating nor any complaint has been lodged against this petitioner. In fact, this petitioner alongwith coaccused Rupesh Kumar were going to Goh for playing the road cricket tournament match and they took lift of the vehicle and had no knowledge about the alleged A.T.M. cards and DEFTUN machine, kept in the vehicle. Petitioner has got clean antecedent and he is in custody since 20.10.2020.
Learned A.P.P. for the State has opposed the bail petition.
Considering the rival submissions of the parties and the materials available on record, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in connection with Goh P.S. Case No. 150 of 2020, on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
