2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 80/238/3(5) of the B.N.S.

3. It is a case of dowry death due to non fulfillment of dowry demand. Petitioner is father-in-law of the deceased.

4. It is submitted by learned counsel for the petitioners that the petitioner is innocent and he has committed no offence. He has falsely been implicated in

It is further submitted that petitioner is father-in-law of the deceased and he has no concern with the mess and business of the deceased as well as her husband. There is inordinate delay of 6 days in lodging the F.I.R. It is further submitted that husband of the deceased is already in judicial custody. From perusal of para 28 of Case Diary, it is evident that petitioner had gone to Punjab for his livelihood, prior to the date of occurrence, as stated by the witness. Moreover, the petitioner is languishing in judicial custody since 03.09.2024. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. It is also submitted that after completion of investigation, charge-sheet has been submitted in this case. Similarly situated co-accused Sunaina Devi has already been granted bail vide order dated 04.12.2024, passed in Cr. Misc. No. 82982 of 2024, by the co-ordinate Bench of this Court.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail, after framing of charge, in connection with Rampurhari P.S. Case No. 134 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Muzaffarpur.
