JUSTICE SANJAY PRIYA ORAL ORDER 01-02-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Sakatpur P.S. Case No. 53/2018, instituted for offences under Section(s) 366A and 376(2)(k) of the Indian Penal Code read with Sections 4, 6 and 8 of POCSO Act.

It is alleged in the written report that this petitioner established physical relation with informant/ O.P. No. 2 on the pretext of marriage on account of which she became pregnant, but the petitioner refused to marry with informant. Learned counsel for the petitioner has submitted that now compromise has been arrived between the parties and the petitioner is ready to perform marriage with the informant after

Patna High Court Cr.Misc. No.4061 of 2019(2) dt.01-02-2019 2/2 being released from jail.

Learned counsel for the informant has appeared and filed Counter Affidavit stating therein that Panchayati was held in the village because the girl is at the advance stage of pregnancy. The petitioner has agreed to marry with informant after coming out from jail.

Petitioner is in custody since 09.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st A.D.J., Darbhanga in connection with Sakatpur P.S. Case No. 53/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.

The petitioner will file affidavit at the time of filing of bail bond that he has entered into compromise with informant as submitted in this Court and he will perform marriage with informant/O.P. no. 2 after being released from custody. (Sanjay Priya, J) rakhi/- U T
