JUSTICE SHIVAJI PANDEY ORAL ORDER 28-05-2020 Heard learned counsel for the petitioners and learned counsel for the State through virtual court proceeding. In this case, the petitioners are seeking bail in connection with Piro P.S. Case No. 302 of 2019 registered for offences under sections 147, 149, 379, 323, 341 and 302 of the Indian Penal Code.

As per allegation made in the F.I.R., on account of certain dispute, all the accused persons jointly started assaulting the victim till his death by different traditional weapons such as Lathi, Danda, brick-bating and iron road.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.3659 of 2020(3) dt.28-05-2020 2/2 petitioner no.2 is a student and has obtained 1st division marks in the last year matriculation examination and has made a request that at least he may be granted bail.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner no.1, above named.

Accordingly, the prayer for bail of the petitioner no.1, namely, Devmuni Yadav alias Devmuni Singh is rejected. Considering the academic career of the petitioner no.2 as also considering the present situation arising out of Covid-19 outbreak, let the petitioner no.2, above named, be released on bail on furnishing personal bail bond to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro P.S. Case No. 302 of 2019.
