JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 This is an application for grant of anticipatory bail in connection with Sonbarsa Raj P.S. Case No. 163 of 2017, disclosing offences under Sections 302, 304(B), 201, 34 of the Indian Penal Code.
Allegation against the petitioner, who happens to be the Bhaisur of the deceased, is of committing dowry death of the deceased.
At the very outset, it has been submitted on behalf of the State and informant that already a proceeding under Section 82 of the Cr.P.C. has been issued against the petitioner, as such, he does not deserves anticipatory bail.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and mother-in-law and sister-in-law have already been
Patna High Court CR. MISC. No.2809 of 2019(4) dt.11-03-2019 2/2 granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 03.07.2018 passed in Cr. Misc. No. 38205 of 2018.
Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered on the basis of materials available on record and also considering the fact that other similarly situated persons have been granted anticipatory bail by a Coordinate Bench of this Court, if possible, on the same day.
