JUSTICE SANJAY KUMAR ORAL ORDER 21-12-2016 Heard the learned counsel for the petitioner and the learned APP for the State.

Petitioner is languishing in custody since 13.09.2016 in connection with Barauni P.S.Case No.336 of 2016 for offence alleged under Sections 47(a) of the Bihar Excise Amendment Act, 2016.

The informant, on confidential information, reached at Rajendra Setu and on search three cartoons total 90 bottles each in Tata Indica Car and ten cartoons wine from Tata Sumo vehicles were seized in presence of witnesses. The police party apprehended all six persons boarding the vehicle including the present petitioner.

Patna High Court Cr.Misc. No.55055 of 2016 (2) dt.21-12-2016 2/2 It has been submitted by the learned counsel for the petitioner that co-accused Bhola Choudhary and Amarnath Singh were also sitting in the said vehicle, have been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No.53221 of 2016 dated 08.12.2016 and petitioner has got no criminal antecedent and remained in custody since 13.09.2016.

However, learned APP for the State submits that the petitioner is named in the FIR, hence opposes the prayer for bail. Considering the aforesaid facts and circumstances of the case as also considering that similarly situated co-accused has been granted bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Barauni P.S.Case No.336 of 2016.
