The petitioner has preferred this application for grant of regular bail in a case registered under section 365 and 34 of the Indian Penal Code to which sections 302, 201 and 120B of the Indian Penal Code was added subsequently. As per the prosecution case, it is stated that the ten named accused persons including the petitioner herein kidnapped the granddaughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. An unfounded and unsubstantiated suspicion has been raised against the petitioner in the FIR. No material has transpired in course of investigation to connect the petitioner with the alleged crime. Patna High Court CR. MISC. No.11922 of 2021(3) dt.17-08-2021 2/2 investigation dead body of the victim Kanchan Kumari was found buried on the river side in a semi burnt condition. The petitioner is in custody since 19.6.2020 and has no criminal antecedent. His case stands on a similar footing to that of a number of co-accused who have been enlarged on bail vide orders brought on records as Annexures-2 series to this petition. Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner having remained in custody for over one year and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Narpatganj P.S. Case no. 136/2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
