JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2016 Heard the learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner seeks bail in connection with Barauni (F.C.I.) P.S. Case No. 155 of 2015 registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, Guddu Kumar, the son of the informant, was telephonically called by the petitioner and seven other F.I.R. named accused persons and thereafter, the son of the informant was found shot dead at Balha Gachhi and the motor cycle of

Submission is of false implication and that the petitioner has been made victim of the circumstances, there is no legal and tangible material against the petitioner, confessional statement of co-accused Golu Kumar has got no value in the eye of law, the informant is not an eye-witness and no one has seen the petitioner committing the crime or in the company of the deceased to which the learned A.P.P. after going through the case diary submits that the petitioner is named in the F.I.R. and further, co-accused confessing his guilt has stated the name of the petitioner and the petitioner has got criminal antecedent. In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Begusarai in connection with Barauni (F.C.I.) P.S. Case No.
