The petitioner is in custody since 28.11.2019 in connection with Kalyanpur P.S. Case No.80 of 2019 registered for the offence under Section 272, 273/34 of the Indian Penal Code and Section 30(a) and 41(1) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the confessional statement made before the police by co-accused namely Krishna Pandit and Sarjun Ram, which has no evidentiary value. It is further submitted that the petitioner has clean antecedent. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,

No.2269 of 2020(2) dt.20-01-2020 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran at Motihari.
