The petitioners are apprehending their arrest in connection with Kishanpur P.S.Case No.68 of 2002 , registered for offences punishable under Sections 498(A), 379 and 494 of the Indian Penal Code.

Allegation against the petitioners is of torturing the complainant/informant for return of the articles given to the daughter of the petitioner no.1 in the marriage and for that subjecting her to cruelty.

Submission of the learned counsel for the petitioners is that there was 'Golat Marriage' in the family of the informant and the petitioners as the informant was married with son of

No.11121 of 2019(4) dt.29-04-2019 2/2 the petitioner no.1 and the daughter of the petitioner no.1 was married with the brother of the informant and later on daughter and the son -in-law of the petitioner no.1 died, as such there is some dispute with respect to property and hence they have been implicated in this false and concocted case. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Supaul in connection with Kishanpur P.S.case No.68 of 2002 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
