The petitioner is languishing in custody since 24.11.2014 in a case registered for the offences punishable under Sections 395/397 of the Indian Penal Code and 3/4 of Explosive Substances Act.
Dacoity was committed in the house of the informant. Name of the petitioner sprang up on the confession of co-accused Abdul Khalik.
Statements have been made in para 9 and 11 of the petition that neither there is any recovery from the petitioner nor the petitioner has been put on T.I.P.
Considering the fact that the petitioner has not
Patna High Court Cr.Misc. No.10740 of 2015 (02) dt.24-03-2015 2/2 been T.I.P., let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa (Balia Belon) P.S. Case No. 183 of 2014.
Since the petitioner has serious criminal antecedent, the learned court below will positively cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
